A.D.A. Amendments Act: The New Standards and New Challenges

On September 25, President Bush signed into law the A.D.A. Amendments Act of 2008. The new law will expand the definition of "disability" and narrows the grounds for employer defenses. The "new" definition of what constitutes a disability is expected to increase the overall number of people considered to be disabled and require employers to accommodate a larger number of employees.

When the A.D.A. was first passed, it led to significant litigation against employers. Will the new law do the same? Find out at a special briefing session on October 27th. This timely program will raise awareness of the following issues:

  • What is the new definition of "disability"?
  • If medication or other mitigating measures can no longer be considered, is everyone disabled?
  • What are the new interpretations of "substantially limits" and "major life activities"?
  • What new obligations are placed on employers?
  • How is the "regarded as" prong of the Act expanded?
  • How can employers protect themselves from claims and lawsuits?
